Construction and engineering
James's construction and engineering practice encompasses the full range of construction disputes.
He appears regularly in the TCC and in domestic arbitrations. He has particular expertise in very high value residential project disputes, and has acted in relation to disputes concerning properties in London and beyond
He also has extensive experience of adjudications, both acting in the adjudications themselves, as well as in the TCC in relation to enforcement and jurisdictional issues. He has been involved in a number of the leading reported cases on adjudication enforcement.
James's practice also encompasses construction-related professional negligence disputes. Previous and current clients include major contractors, development firms, as well as private clients and a range of construction professionals.
Energy & International Arbitration
James has acted in numerous major international disputes, including ICC, HKIAC, UNCITRAL and LCIA arbitrations. He has been involved in major energy, engineering and construction disputes, as well as disputes about natural resources contracts. Cases have related to matters such as the BTCC pipeline in Turkey and international road projects in Africa, as well as disputes spanning multiple jurisdictions including India, Pakistan, Hong Kong, China, the middle east, Nigeria, Cote D’Ivoire, Ghana and Equatorial Guinea. He is increasingly instructed in large high-value, document-heavy disputes, both with a leader and in his own right.
James is regularly instructed in general commercial disputes, and he has particular experience in relation to freezing orders and other forms of injunctive relief. He is often sought and instructed in relation to cases which have a cross-over between construction and commercial law, including cases involving issues related to insolvency law and directors' duties.
Banking and finance
James has significant experience in banking and finance disputes, including trade and purchase finance, invoice discounting and factoring. H He has appeared on behalf of the trade finance departments of several major banks and commercial finance houses and is regularly instructed in relation to asset-based lending disputes.
His banking and finance practice covers all associated areas such as commercial fraud and he advises regularly on the taking and enforcement of all forms of security, in particular bonds, guarantees and indemnities, where his commercial practice and his construction and engineering expertise frequently overlap.
James is regularly instructed in cases with an insolvency aspect. He has appeared in the Companies Court on numerous occasions and he has particular expertise on advising and representing clients in construction and commercial disputes where there is an insolvency aspect. Recent instructions include a cross-border dispute regarding a sale and purchase of shares relating to a Hong Kong listed company operating mining licences in Tajikistan.
